Engagements and scope
MAKO services are quoted per engagement. Depending on the work, fees may be a monthly retainer, a project fee, or a defined hybrid of the two. Scope, fees, and any data access the work requires are agreed in writing before work begins.
What MAKO does not guarantee
MAKO does not guarantee sales, rankings, market share, funding, or valuation outcomes. Markets, platforms, and competitors change, and no outside team controls every variable that affects them. What MAKO commits to is a transparent starting baseline, disciplined execution, and clear reporting on what changed and why.
Measurement and reporting
Reporting definitions — what counts as a sale, a qualified conversation, contribution profit, or any other measure used in an engagement — are agreed during setup and applied consistently afterward. Profit and margin views MAKO provides are management information meant to support decisions. They are not audited financial statements, and they do not replace the client's own accounting, tax, or legal advice.
Ownership
The client owns its accounts, its data, its decisions, and its operating history — during the engagement and after it. If an engagement ends, MAKO hands over the MAKO Handoff Standard:
- Account and access register
- Current performance baseline
- Decision and action history
- Active priorities and risks
- Client-specific operating playbooks
- Reporting definitions
- Open work and next-step roadmap
MAKO keeps ownership of its own universal systems, methods, and tooling — the engines it built before the engagement and continues to run across its business. Those stay separate from what transfers to the client.
Confidentiality
Both parties keep the other's confidential information private, and use it only for the purposes of the engagement.
Liability
MAKO's liability arising from an engagement is limited to the fees paid in the three months before the claim arose.
Termination
Either party may end an engagement on the terms set out in that engagement's own agreement.
Governing law
These terms are governed by the laws of the jurisdiction in which MAKO Commercial Inc. is incorporated.
Changes to these terms
MAKO may update these terms as the service changes. The date at the top shows when they were last revised.
